These Terms of Use (“Terms”) govern your access to and use of the Drawpunkt website, drawing tools, artwork replay system, artist profiles, artist channels, live chat rooms, comments, ratings, subscriptions, notifications and all related services collectively referred to as the “Service”.
By accessing Drawpunkt, creating an account, publishing artwork, posting a comment, joining a live chat room or otherwise using the Service, you confirm that you have read, understood and agreed to these Terms.
If you do not agree to these Terms, you must not access or use the Service.
1. ABOUT DRAWPUNKT
Drawpunkt is an online creative community where artists can create, save, publish, display and share digital artwork.
Drawpunkt may record the drawing process as a sequence of drawing actions. This allows published artwork to be replayed from the first recorded stroke to the final result.
The Service may include:
• Browser-based drawing tools;
• Pressure-sensitive pen support on compatible devices;
• Draft saving and artwork publishing;
• Drawing process recording and replay;
• Public artist profiles;
• Artist channels and customizable channel pages;
• Artwork likes and ratings;
• Comments and artist replies;
• Comment approval tools;
• Channel subscriptions and notifications;
• Public and slugspecific live chat rooms;
• Competitions and community activities;
• Direct image advertisements;
• Third-party advertising, including Google advertising services;
• Reporting and moderation tools.
Drawpunkt may add, modify, suspend or remove features when reasonably necessary to maintain, improve or secure the Service.
2. ELIGIBILITY
You must be legally capable of entering into a binding agreement to create and operate a Drawpunkt account.
If you are under the age at which you may independently consent to online services in your country, you may use Drawpunkt only with permission and supervision from a parent or legal guardian.
Parents and legal guardians are responsible for supervising the use of Drawpunkt by minors under their care.
Drawpunkt may request reasonable information to verify a user’s age, identity, account ownership or legal authority where necessary for safety, legal compliance or dispute resolution.
3. ACCOUNT REGISTRATION
Some Drawpunkt content may be viewed without an account. Visitors who are not signed in may watch public artwork and available drawing replays.
An account is required to use member features, including:
• Creating and saving artwork;
• Publishing artwork;
• Liking artwork;
• Rating artwork;
• Submitting comments;
• Replying to eligible comments;
• Posting messages in live chat rooms;
• Subscribing to artist channels;
• Receiving account and channel notifications;
• Creating or managing an artist channel when eligible.
You agree to provide accurate, current and complete registration information.
You are responsible for:
• Protecting your password;
• Maintaining control of your email account;
• Keeping your account information accurate;
• Preventing unauthorized access to your account;
• All activity performed through your account unless you promptly report unauthorized access.
You must not share, sell, rent, transfer or commercially trade your Drawpunkt account.
You must notify Drawpunkt promptly if you believe that your account or password has been compromised.
Drawpunkt may require a password reset, temporarily restrict an account or request additional verification when suspicious activity is detected.
4. USERNAMES, DISPLAY NAMES AND IDENTITY
Your username, display name, profile image, channel name and other public identity elements must not:
• Impersonate another person, artist, organization or brand;
• Falsely claim an official relationship or endorsement;
• Infringe a trademark, copyright or other legal right;
• Contain threats, hate speech, sexual exploitation, harassment or unlawful material;
• Intentionally mislead other users;
• Be used to evade a previous suspension or permanent ban.
Drawpunkt may change, reserve, restrict or remove usernames and channel names when reasonably necessary to prevent impersonation, infringement, confusion, fraud or abuse.
A username or channel name does not provide ownership of a trademark or other exclusive legal right.
5. ARTWORK OWNERSHIP
You retain ownership of original artwork and other original content that you create and publish on Drawpunkt.
Drawpunkt does not claim ownership of your original artwork.
You must own the content you upload or possess all permissions, licences and legal rights required to publish it through the Service.
You must not upload, trace, reproduce, modify or publish another person’s artwork unless you have permission or another valid legal basis to do so.
You are responsible for keeping your own backup copies of artwork, replay files and other important content.
Drawpunkt is not a permanent archival or backup service and does not guarantee that content will remain available indefinitely.
6. LICENCE GRANTED TO DRAWPUNKT
When you upload, save or publish content, you grant Drawpunkt a non-exclusive, worldwide, royalty-free and limited licence to:
• Store and process the content;
• Display published content through the Service;
• Generate thumbnails and responsive image versions;
• Reproduce the content as technically required to operate the Service;
• Play and display the recorded drawing process;
• Display the content on your profile, artist channel, galleries and discovery areas;
• Deliver the content through hosting, caching and content-delivery systems;
• Promote the content within Drawpunkt;
• Display reasonable previews when Drawpunkt pages are shared;
• Moderate, investigate or preserve the content where required for safety or legal compliance.
This licence exists only to operate, secure, improve and promote the Drawpunkt Service.
The licence ends when the content is permanently deleted from active systems, except where temporary backup copies, security records, legal preservation duties or previously generated records must reasonably be retained.
Drawpunkt will not sell ownership of your artwork to another party merely because it was published through the Service.
7. DRAWING RECORDS AND REPLAY DATA
Drawpunkt may record drawing actions such as:
• Brush and pencil movements;
• Stroke position and timing;
• Pen pressure where supported;
• Brush size, color and opacity;
• Layer information;
• Text placement;
• Canvas background settings;
• Replay speed and sequence information.
This information may be stored as replay data and used to reconstruct the visible drawing process.
Replay data represents recorded interactions with the drawing tool. It is not guaranteed to reproduce every visual detail identically on every browser, device or future software version.
By publishing artwork with replay data, you authorize Drawpunkt to make that replay available to visitors together with the published artwork.
You must not manipulate replay data to distribute malicious code, damage the Service, misrepresent another person’s activity or bypass security controls.
8. DRAFTS AND PUBLISHED ARTWORK
Draft artwork is intended to remain available to the account that created it unless otherwise stated.
Published artwork may be visible to visitors, registered users, search engines and external services that link to or index public pages.
Before publishing, you are responsible for confirming that:
• The artwork is ready to be made public;
• You have the legal right to publish it;
• The title and description are accurate;
• The artwork does not reveal private or confidential information;
• The content complies with these Terms.
Drawpunkt may prevent, delay, hide, archive or remove publication where content violates these Terms, presents a security risk or is subject to a credible legal complaint.
9. PROHIBITED CONTENT
You must not create, upload, publish, transmit, promote or link to content that:
• Is illegal or encourages illegal conduct;
• Infringes copyright, trademark, privacy, publicity or other rights;
• Sexually exploits or endangers a child;
• Contains child sexual abuse material;
• Promotes terrorism or violent extremist activity;
• Contains credible threats of violence;
• Encourages suicide, self-harm or dangerous conduct;
• Contains non-consensual sexual or intimate material;
• Promotes hatred or violence against protected groups;
• Harasses, stalks, intimidates or humiliates another person;
• Publishes private personal information without permission;
• Impersonates another person or organization;
• Is fraudulent, deceptive or designed to manipulate users;
• Contains malware, malicious scripts or harmful code;
• Attempts to steal passwords, tokens or personal information;
• Is spam, repetitive advertising or unauthorized commercial solicitation;
• Manipulates likes, ratings, subscriptions or other platform measurements;
• Attempts to evade moderation, suspension or a permanent ban;
• Interferes with the operation or security of the Service.
Artistic, educational, documentary or newsworthy context may be considered during moderation, but context does not automatically make otherwise unlawful or harmful content acceptable.
10. ARTIFICIAL INTELLIGENCE AND MISLEADING CONTENT
If artwork is substantially generated or transformed using artificial intelligence, you should disclose this where the absence of disclosure could materially mislead viewers.
You must not use artificial intelligence or editing tools to:
• Impersonate a real person deceptively;
• Create unlawful sexual or exploitative material;
• Falsely attribute artwork to another artist;
• Fabricate evidence of real-world events;
• Infringe another person’s legal rights;
• Evade copyright or moderation systems.
Drawpunkt may introduce labels or disclosure tools for AI-assisted content.
11. LIKES AND ART RATINGS
Registered users may be allowed to like or rate eligible artwork.
A user must not use multiple accounts, automated systems, paid engagement schemes or coordinated manipulation to alter likes, ratings, subscriptions or popularity measurements.
Drawpunkt may remove fraudulent or suspicious engagement and recalculate displayed totals.
Ratings are subjective opinions submitted by users. Drawpunkt does not guarantee that a rating accurately measures artistic quality, professional skill or commercial value.
Drawpunkt may use likes, ratings, views, comments, replay activity, subscriptions and other signals to organize galleries, determine trending content or assess eligibility for artist features.
12. COMMENTS AND ARTIST APPROVAL
Comments submitted to artwork may require approval from the artist before becoming publicly visible.
The artist may approve or reject eligible comments submitted to their artwork.
By approving a comment, the artist confirms that they have reviewed it and consider it suitable for public display under these Terms.
Artist approval does not prevent Drawpunkt administrators or moderators from reviewing, hiding or removing the comment later.
Artists must not knowingly approve comments containing:
• Harassment or threats;
• Hate speech;
• Sexual exploitation;
• Illegal content;
• Spam;
• Malicious links;
• Personal information published without permission;
• Copyright infringement;
• Other content prohibited by these Terms.
The artist who created an artwork may be prevented from posting a new primary comment directly on their own artwork. The artist may reply to approved comments where the reply feature is available.
Replies must remain relevant and comply with the same rules that apply to primary comments.
Drawpunkt retains final authority over whether a comment or reply remains available through the Service.
13. LIVE CHAT ROOMS
Drawpunkt may provide a general community chat room and slugspecific chat rooms.
Messages posted before a user joins a live session may not be displayed to that user. Drawpunkt may use session cursors or similar technical controls to determine which messages are delivered after entry.
Live chat is not guaranteed to provide permanent message history.
You must not use chat rooms to:
• Harass, threaten or intimidate;
• Publish hate speech;
• Share illegal or sexually exploitative material;
• Send spam or repetitive promotional messages;
• Share malicious or deceptive links;
• Request or disclose passwords or sensitive personal information;
• Circumvent blocked-word or moderation systems;
• Organize manipulation of likes, ratings or subscriptions;
• Disrupt the conversation through flooding or automated messages.
Drawpunkt may use automated filters, rate limits, blocked-term lists and human moderation.
Automated filters may make mistakes and do not replace user responsibility.
Messages may be removed without advance notice when reasonably necessary to protect users, enforce these Terms or comply with law.
14. ARTIST CHANNELS
Eligible users may be permitted to create an artist channel connected to their Drawpunkt account.
Eligibility may depend on factors such as:
• Number of published artworks;
• Engagement received by individual artworks;
• Total likes or ratings;
• Account age and standing;
• Compliance history;
• Authentic community participation;
• Other quality and safety signals.
Meeting numerical criteria does not create an unconditional right to operate a channel. Drawpunkt may review account safety, authenticity and compliance before activation.
An artist channel may allow its owner to customize:
• Channel name;
• Description;
• Hero title and subtitle;
• Profile cover image;
• Channel background image;
• Background and accent colors;
• Text colors;
• Typography;
• Links to artwork and live chat.
Channel owners are responsible for ensuring that their customized page remains readable, lawful and suitable for the community.
Drawpunkt may adjust or remove customization that interferes with navigation, accessibility, security, advertising requirements or site functionality.
15. CHANNEL SUBSCRIPTIONS AND NOTIFICATIONS
Registered users may subscribe to eligible artist channels.
A subscription may allow the subscriber to:
• Find the channel from the Subscriptions page;
• Access the artist’s public channel;
• Enter an available artist chat room;
• Receive notifications when the artist publishes new artwork;
• Receive other channel-related updates introduced by Drawpunkt.
Subscriptions are currently community features and do not create a paid commercial relationship unless Drawpunkt expressly introduces a paid subscription product under separate terms.
Users may unsubscribe using the available account controls.
Drawpunkt does not guarantee delivery of every notification.
16. CHANNEL DESIGN AND UPLOADED IMAGES
Channel owners may upload profile pictures, cover images, logos and background images.
Uploaded files must:
• Be owned or lawfully licensed by the uploader;
• Be in a supported format;
• Remain within applicable file-size limits;
• Contain no malicious payload or executable code;
• Comply with copyright, privacy and community rules;
• Avoid deceptive interface elements that imitate Drawpunkt controls.
Drawpunkt may resize, crop, compress, convert or reject uploaded images for technical, safety or performance reasons.
17. COMPETITIONS AND PROMOTIONAL ACTIVITIES
Drawpunkt may offer competitions, challenges or promotional events.
Additional rules may apply to a particular event, including eligibility, deadlines, judging standards, prizes and required licences.
If event-specific rules conflict with these Terms, the event-specific rules control only for that event.
Drawpunkt may disqualify entries involving fraud, plagiarism, automated engagement, rule evasion or other unfair conduct.
18. ADVERTISING
Drawpunkt may display direct image advertisements and third-party advertisements, including advertisements delivered through Google advertising services.
The display of an advertisement does not necessarily mean that Drawpunkt endorses the advertiser, product, service or destination website.
Advertisers and linked websites are responsible for their own content, products, claims and privacy practices.
You should review the terms and privacy policies of third-party services before interacting with them.
Advertising technologies may use cookies or similar technologies where permitted by law and, where required, after appropriate consent.
Drawpunkt may change advertisement placement, format, frequency and provider.
Users must not generate invalid ad impressions or clicks, encourage others to click advertisements, automate advertising interaction or otherwise manipulate advertising systems.
19. COPYRIGHT COMPLAINTS
Drawpunkt respects intellectual property rights.
If you believe that content available through Drawpunkt infringes your copyright, you may submit a notice through the contact information made available on the Contact page.
A copyright notice should include sufficient information to identify:
• The copyrighted work claimed to have been infringed;
• The allegedly infringing Drawpunkt content;
• The exact URL of the relevant artwork, profile or channel;
• Your name and contact information;
• The basis of your authority to act;
• A good-faith statement that the disputed use is not authorized;
• A statement that the information provided is accurate;
• Any signature or declaration required by applicable law.
Drawpunkt may remove or restrict access to disputed content while reviewing a complaint.
Drawpunkt may notify the affected user and may accept a counter-notice where permitted by applicable law.
Repeated infringement may result in account restriction or permanent termination.
False, misleading or abusive copyright complaints may have legal consequences.
20. REPORTING CONTENT
Users may report artwork, comments, replies, profiles, channels or chat messages using available reporting tools or the Contact page.
Reports should be made honestly and should include enough information for review.
You must not use reporting tools to harass users, suppress lawful criticism, manipulate competition or submit knowingly false claims.
Submitting a report does not guarantee removal. Drawpunkt may consider context, evidence, applicable law and these Terms.
21. MODERATION AND ENFORCEMENT
Drawpunkt may use automated systems, manual review or both to detect and address violations.
Depending on the nature, severity, frequency and context of a violation, Drawpunkt may:
• Issue a warning;
• Reject or remove content;
• Disable comments or chat access;
• Hide or archive artwork;
• Restrict publication;
• Pause or close an artist channel;
• Remove fraudulent engagement;
• Require account verification;
• Temporarily suspend an account;
• Apply a 15-day suspension;
• Apply a 30-day suspension;
• Permanently ban an account;
• Preserve relevant records;
• Report activity to competent authorities when required.
The progressive 15-day, 30-day and permanent-ban structure may generally be used for repeated violations. Drawpunkt may skip intermediate stages when conduct is severe, unlawful, dangerous, fraudulent or presents an immediate risk.
Attempts to evade enforcement through another account may result in restriction of all related accounts.
22. MODERATION DECISIONS AND APPEALS
Where an appeal or contact mechanism is available, a user may request review of a moderation decision.
An appeal should identify:
• The affected account or content;
• The decision being challenged;
• Why the user believes the decision was incorrect;
• Any relevant evidence or context.
Submitting an appeal does not automatically restore content or account access.
Drawpunkt may maintain a restriction while an appeal is reviewed where necessary for safety, security or legal compliance.
Repeated, abusive or fraudulent appeals may be rejected.
23. PLATFORM SECURITY
You must not:
• Probe or scan the Service for vulnerabilities without written authorization;
• Bypass authentication, authorization or rate limits;
• Access another user’s account or private data;
• Inject scripts, SQL, commands or malicious code;
• Interfere with servers, databases or network resources;
• Scrape the Service in a manner that creates excessive load;
• Reverse engineer security mechanisms;
• Use bots to create accounts, messages or engagement;
• Upload files designed to disguise executable content;
• Exploit a vulnerability instead of responsibly reporting it.
Security problems should be reported privately using the Contact page or support email.
Publicly disclosing an uncorrected vulnerability in a manner that creates a material risk may violate these Terms.
24. ACCOUNT SUSPENSION AND TERMINATION
You may stop using Drawpunkt at any time.
Where account cancellation is available, cancellation may permanently disable your account and remove or anonymize associated profile information.
Some information may remain where reasonably required for:
• Legal obligations;
• Fraud and abuse prevention;
• Security investigations;
• Dispute resolution;
• Enforcement records;
• Backup integrity;
• Copyright or other legal claims.
Drawpunkt may suspend or terminate an account that violates these Terms, creates risk, remains involved in fraudulent activity or must be restricted by law.
Permanent termination may prevent the user from registering another account.
25. CONTENT REMOVAL AFTER ACCOUNT CLOSURE
Closing an account does not guarantee immediate removal of every copy of content from backups, caches, search engine indexes or third-party pages.
Public content may remain temporarily accessible through technical caches after removal from active Drawpunkt pages.
Comments or replies may be removed, anonymized or retained where necessary to preserve conversation integrity, enforcement evidence or legal records.
Drawpunkt will process deletion requests in accordance with applicable law and its Privacy Policy.
26. THIRD-PARTY SERVICES AND LINKS
Drawpunkt may contain links to third-party websites, advertising services, hosting providers, analytics tools or embedded services.
Drawpunkt does not control every third-party service and is not responsible for third-party availability, security, terms, content or privacy practices.
Your use of third-party services may be governed by separate terms.
27. SERVICE AVAILABILITY
Drawpunkt aims to provide a reliable Service but does not guarantee uninterrupted or error-free availability.
The Service may be unavailable because of:
• Maintenance;
• Software updates;
• Hosting failures;
• Network interruptions;
• Security incidents;
• Database problems;
• Force majeure events;
• Legal or regulatory requirements;
• Circumstances outside reasonable control.
Features and stored content may occasionally be delayed, damaged or lost. You should maintain independent copies of important artwork.
28. BETA AND EXPERIMENTAL FEATURES
Some features may be identified as beta, preview, test or experimental.
Experimental features may be incomplete, changed frequently or removed without notice.
You use experimental features at your own risk and should not rely on them as the only storage location for important content.
29. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, Drawpunkt is provided on an “as is” and “as available” basis.
Drawpunkt does not guarantee that:
• The Service will always be available;
• Every feature will operate without error;
• Content will never be lost;
• Replay data will reproduce identically on every device;
• User-generated content will be accurate or lawful;
• Every harmful message will be detected immediately;
• Every notification will be delivered;
• Artist ratings will reflect professional quality;
• The Service will meet every user’s individual requirements.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
30. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Drawpunkt and its operators, administrators, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from use of the Service.
This may include loss of data, artwork, reputation, opportunity, income, audience, subscriptions or expected benefits.
Nothing in these Terms limits liability where limitation is prohibited by law, including liability that cannot legally be excluded for fraud, intentional misconduct, death or personal injury.
31. USER RESPONSIBILITY AND INDEMNITY
You are responsible for your content, account activity and use of the Service.
To the extent permitted by applicable law, you agree to defend and indemnify Drawpunkt and its operators against third-party claims arising from:
• Content you upload or publish;
• Your infringement of another person’s rights;
• Your unlawful use of the Service;
• Your material violation of these Terms;
• Fraudulent or malicious activity conducted through your account.
This obligation does not apply where a claim results solely from Drawpunkt’s own unlawful conduct.
32. PRIVACY AND COOKIES
Drawpunkt’s collection and use of personal information are described in the Privacy Policy.
The use of cookies and similar technologies is described in the Cookie Policy.
These Terms, the Privacy Policy and the Cookie Policy should be read together.
If consent is legally required for non-essential cookies or personalized advertising, Drawpunkt will seek consent through available consent controls.
33. CHANGES TO THE SERVICE
Drawpunkt may change the Service to improve performance, introduce features, respond to security concerns, comply with law or discontinue features that are no longer practical.
Where reasonably possible, Drawpunkt may provide notice of material changes that significantly affect registered users.
Drawpunkt is not required to preserve a particular design, feature, eligibility rule, ranking method or storage format permanently.
34. CHANGES TO THESE TERMS
Drawpunkt may update these Terms when the Service, law, safety requirements or business practices change.
The updated version will display a revised “Last Updated” date.
Where required by law or where changes materially affect user rights, Drawpunkt may provide additional notice.
Continued use after updated Terms take effect constitutes acceptance where permitted by law.
If you do not agree to an updated version, you must stop using the Service and may use available account cancellation controls.
35. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws that apply to the Drawpunkt operator, subject to mandatory consumer protections and other rights that apply in the user’s country of residence.
Before starting formal proceedings, users are encouraged to contact Drawpunkt and attempt to resolve the issue informally.
Nothing in these Terms removes a user’s right to contact a competent court, consumer authority, data protection authority or other regulator where that right is provided by law.
The Drawpunkt operator’s legal identity, business address and applicable jurisdiction should be published on the Contact page before commercial launch.
36. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
The invalid provision will be interpreted or limited only to the minimum extent necessary to make it lawful and enforceable where permitted.
37. NO WAIVER
If Drawpunkt does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.
38. TRANSFER
You may not transfer your rights or obligations under these Terms without prior written permission.
Drawpunkt may transfer its rights and obligations as part of a merger, acquisition, restructuring, asset transfer or change of operator, subject to applicable law.
39. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Cookie Policy, applicable competition rules and any clearly identified additional terms, form the agreement governing your use of Drawpunkt.
40. CONTACT
For questions about these Terms, account restrictions, content moderation, copyright, privacy or security, contact Drawpunkt through the Contact page or the support email published on the website.
When contacting Drawpunkt, include relevant information such as:
• Your username;
• The affected artwork, profile, channel or message URL;
• A clear description of the issue;
• Supporting evidence where appropriate.
Do not send passwords, authentication tokens or unnecessary sensitive personal information.
By using Drawpunkt, you confirm that you have read, understood and agreed to these Terms of Use.

Drawpunkt may request reasonable information to verify a user’s age, identity, account ownership or legal authority where necessary for safety, legal compliance or dispute resolution.
3. ACCOUNT REGISTRATION
Some Drawpunkt content may be viewed without an account. Visitors who are not signed in may watch public artwork and available drawing replays.
An account is required to use member features, including:
• Creating and saving artwork;
• Publishing artwork;
• Liking artwork;
• Rating artwork;
• Submitting comments;
• Replying to eligible comments;
• Posting messages in live chat rooms;
• Subscribing to artist channels;
• Receiving account and channel notifications;
• Creating or managing an artist channel when eligible.
You agree to provide accurate, current and complete registration information.
You are responsible for:
• Protecting your password;
• Maintaining control of your email account;
• Keeping your account information accurate;
• Preventing unauthorized access to your account;
• All activity performed through your account unless you promptly report unauthorized access.
You must not share, sell, rent, transfer or commercially trade your Drawpunkt account.
You must notify Drawpunkt promptly if you believe that your account or password has been compromised.
Drawpunkt may require a password reset, temporarily restrict an account or request additional verification when suspicious activity is detected.
4. USERNAMES, DISPLAY NAMES AND IDENTITY
Your username, display name, profile image, channel name and other public identity elements must not:
• Impersonate another person, artist, organization or brand;
• Falsely claim an official relationship or endorsement;
• Infringe a trademark, copyright or other legal right;
• Contain threats, hate speech, sexual exploitation, harassment or unlawful material;
• Intentionally mislead other users;
• Be used to evade a previous suspension or permanent ban.
Drawpunkt may change, reserve, restrict or remove usernames and channel names when reasonably necessary to prevent impersonation, infringement, confusion, fraud or abuse.
A username or channel name does not provide ownership of a trademark or other exclusive legal right.
5. ARTWORK OWNERSHIP
You retain ownership of original artwork and other original content that you create and publish on Drawpunkt.
Drawpunkt does not claim ownership of your original artwork.
You must own the content you upload or possess all permissions, licences and legal rights required to publish it through the Service.
You must not upload, trace, reproduce, modify or publish another person’s artwork unless you have permission or another valid legal basis to do so.
You are responsible for keeping your own backup copies of artwork, replay files and other important content.
Drawpunkt is not a permanent archival or backup service and does not guarantee that content will remain available indefinitely.
6. LICENCE GRANTED TO DRAWPUNKT
When you upload, save or publish content, you grant Drawpunkt a non-exclusive, worldwide, royalty-free and limited licence to:
• Store and process the content;
• Display published content through the Service;
• Generate thumbnails and responsive image versions;
• Reproduce the content as technically required to operate the Service;
• Play and display the recorded drawing process;
• Display the content on your profile, artist channel, galleries and discovery areas;
• Deliver the content through hosting, caching and content-delivery systems;
• Promote the content within Drawpunkt;
• Display reasonable previews when Drawpunkt pages are shared;
• Moderate, investigate or preserve the content where required for safety or legal compliance.
This licence exists only to operate, secure, improve and promote the Drawpunkt Service.
The licence ends when the content is permanently deleted from active systems, except where temporary backup copies, security records, legal preservation duties or previously generated records must reasonably be retained.
Drawpunkt will not sell ownership of your artwork to another party merely because it was published through the Service.
7. DRAWING RECORDS AND REPLAY DATA
Drawpunkt may record drawing actions such as:
• Brush and pencil movements;
• Stroke position and timing;
• Pen pressure where supported;
• Brush size, color and opacity;
• Layer information;
• Text placement;
• Canvas background settings;
• Replay speed and sequence information.
This information may be stored as replay data and used to reconstruct the visible drawing process.
Replay data represents recorded interactions with the drawing tool. It is not guaranteed to reproduce every visual detail identically on every browser, device or future software version.
By publishing artwork with replay data, you authorize Drawpunkt to make that replay available to visitors together with the published artwork.
You must not manipulate replay data to distribute malicious code, damage the Service, misrepresent another person’s activity or bypass security controls.
8. DRAFTS AND PUBLISHED ARTWORK
Draft artwork is intended to remain available to the account that created it unless otherwise stated.
Published artwork may be visible to visitors, registered users, search engines and external services that link to or index public pages.
Before publishing, you are responsible for confirming that:
• The artwork is ready to be made public;
• You have the legal right to publish it;
• The title and description are accurate;
• The artwork does not reveal private or confidential information;
• The content complies with these Terms.
Drawpunkt may prevent, delay, hide, archive or remove publication where content violates these Terms, presents a security risk or is subject to a credible legal complaint.
9. PROHIBITED CONTENT
You must not create, upload, publish, transmit, promote or link to content that:
• Is illegal or encourages illegal conduct;
• Infringes copyright, trademark, privacy, publicity or other rights;
• Sexually exploits or endangers a child;
• Contains child sexual abuse material;
• Promotes terrorism or violent extremist activity;
• Contains credible threats of violence;
• Encourages suicide, self-harm or dangerous conduct;
• Contains non-consensual sexual or intimate material;
• Promotes hatred or violence against protected groups;
• Harasses, stalks, intimidates or humiliates another person;
• Publishes private personal information without permission;
• Impersonates another person or organization;
• Is fraudulent, deceptive or designed to manipulate users;
• Contains malware, malicious scripts or harmful code;
• Attempts to steal passwords, tokens or personal information;
• Is spam, repetitive advertising or unauthorized commercial solicitation;
• Manipulates likes, ratings, subscriptions or other platform measurements;
• Attempts to evade moderation, suspension or a permanent ban;
• Interferes with the operation or security of the Service.
Artistic, educational, documentary or newsworthy context may be considered during moderation, but context does not automatically make otherwise unlawful or harmful content acceptable.
10. ARTIFICIAL INTELLIGENCE AND MISLEADING CONTENT
If artwork is substantially generated or transformed using artificial intelligence, you should disclose this where the absence of disclosure could materially mislead viewers.
You must not use artificial intelligence or editing tools to:
• Impersonate a real person deceptively;
• Create unlawful sexual or exploitative material;
• Falsely attribute artwork to another artist;
• Fabricate evidence of real-world events;
• Infringe another person’s legal rights;
• Evade copyright or moderation systems.
Drawpunkt may introduce labels or disclosure tools for AI-assisted content.
11. LIKES AND ART RATINGS
Registered users may be allowed to like or rate eligible artwork.
A user must not use multiple accounts, automated systems, paid engagement schemes or coordinated manipulation to alter likes, ratings, subscriptions or popularity measurements.
Drawpunkt may remove fraudulent or suspicious engagement and recalculate displayed totals.
Ratings are subjective opinions submitted by users. Drawpunkt does not guarantee that a rating accurately measures artistic quality, professional skill or commercial value.
Drawpunkt may use likes, ratings, views, comments, replay activity, subscriptions and other signals to organize galleries, determine trending content or assess eligibility for artist features.
12. COMMENTS AND ARTIST APPROVAL
Comments submitted to artwork may require approval from the artist before becoming publicly visible.
The artist may approve or reject eligible comments submitted to their artwork.
By approving a comment, the artist confirms that they have reviewed it and consider it suitable for public display under these Terms.
Artist approval does not prevent Drawpunkt administrators or moderators from reviewing, hiding or removing the comment later.
Artists must not knowingly approve comments containing:
• Harassment or threats;
• Hate speech;
• Sexual exploitation;
• Illegal content;
• Spam;
• Malicious links;
• Personal information published without permission;
• Copyright infringement;
• Other content prohibited by these Terms.
The artist who created an artwork may be prevented from posting a new primary comment directly on their own artwork. The artist may reply to approved comments where the reply feature is available.
Replies must remain relevant and comply with the same rules that apply to primary comments.
Drawpunkt retains final authority over whether a comment or reply remains available through the Service.
13. LIVE CHAT ROOMS
Drawpunkt may provide a general community chat room and slugspecific chat rooms.
Messages posted before a user joins a live session may not be displayed to that user. Drawpunkt may use session cursors or similar technical controls to determine which messages are delivered after entry.
Live chat is not guaranteed to provide permanent message history.
You must not use chat rooms to:
• Harass, threaten or intimidate;
• Publish hate speech;
• Share illegal or sexually exploitative material;
• Send spam or repetitive promotional messages;
• Share malicious or deceptive links;
• Request or disclose passwords or sensitive personal information;
• Circumvent blocked-word or moderation systems;
• Organize manipulation of likes, ratings or subscriptions;
• Disrupt the conversation through flooding or automated messages.
Drawpunkt may use automated filters, rate limits, blocked-term lists and human moderation.
Automated filters may make mistakes and do not replace user responsibility.
Messages may be removed without advance notice when reasonably necessary to protect users, enforce these Terms or comply with law.
14. ARTIST CHANNELS
Eligible users may be permitted to create an artist channel connected to their Drawpunkt account.
Eligibility may depend on factors such as:
• Number of published artworks;
• Engagement received by individual artworks;
• Total likes or ratings;
• Account age and standing;
• Compliance history;
• Authentic community participation;
• Other quality and safety signals.
Meeting numerical criteria does not create an unconditional right to operate a channel. Drawpunkt may review account safety, authenticity and compliance before activation.
An artist channel may allow its owner to customize:
• Channel name;
• Description;
• Hero title and subtitle;
• Profile cover image;
• Channel background image;
• Background and accent colors;
• Text colors;
• Typography;
• Links to artwork and live chat.
Channel owners are responsible for ensuring that their customized page remains readable, lawful and suitable for the community.
Drawpunkt may adjust or remove customization that interferes with navigation, accessibility, security, advertising requirements or site functionality.
15. CHANNEL SUBSCRIPTIONS AND NOTIFICATIONS
Registered users may subscribe to eligible artist channels.
A subscription may allow the subscriber to:
• Find the channel from the Subscriptions page;
• Access the artist’s public channel;
• Enter an available artist chat room;
• Receive notifications when the artist publishes new artwork;
• Receive other channel-related updates introduced by Drawpunkt.
Subscriptions are currently community features and do not create a paid commercial relationship unless Drawpunkt expressly introduces a paid subscription product under separate terms.
Users may unsubscribe using the available account controls.
Drawpunkt does not guarantee delivery of every notification.
16. CHANNEL DESIGN AND UPLOADED IMAGES
Channel owners may upload profile pictures, cover images, logos and background images.
Uploaded files must:
• Be owned or lawfully licensed by the uploader;
• Be in a supported format;
• Remain within applicable file-size limits;
• Contain no malicious payload or executable code;
• Comply with copyright, privacy and community rules;
• Avoid deceptive interface elements that imitate Drawpunkt controls.
Drawpunkt may resize, crop, compress, convert or reject uploaded images for technical, safety or performance reasons.
17. COMPETITIONS AND PROMOTIONAL ACTIVITIES
Drawpunkt may offer competitions, challenges or promotional events.
Additional rules may apply to a particular event, including eligibility, deadlines, judging standards, prizes and required licences.
If event-specific rules conflict with these Terms, the event-specific rules control only for that event.
Drawpunkt may disqualify entries involving fraud, plagiarism, automated engagement, rule evasion or other unfair conduct.
18. ADVERTISING
Drawpunkt may display direct image advertisements and third-party advertisements, including advertisements delivered through Google advertising services.
The display of an advertisement does not necessarily mean that Drawpunkt endorses the advertiser, product, service or destination website.
Advertisers and linked websites are responsible for their own content, products, claims and privacy practices.
You should review the terms and privacy policies of third-party services before interacting with them.
Advertising technologies may use cookies or similar technologies where permitted by law and, where required, after appropriate consent.
Drawpunkt may change advertisement placement, format, frequency and provider.
Users must not generate invalid ad impressions or clicks, encourage others to click advertisements, automate advertising interaction or otherwise manipulate advertising systems.
19. COPYRIGHT COMPLAINTS
Drawpunkt respects intellectual property rights.
If you believe that content available through Drawpunkt infringes your copyright, you may submit a notice through the contact information made available on the Contact page.
A copyright notice should include sufficient information to identify:
• The copyrighted work claimed to have been infringed;
• The allegedly infringing Drawpunkt content;
• The exact URL of the relevant artwork, profile or channel;
• Your name and contact information;
• The basis of your authority to act;
• A good-faith statement that the disputed use is not authorized;
• A statement that the information provided is accurate;
• Any signature or declaration required by applicable law.
Drawpunkt may remove or restrict access to disputed content while reviewing a complaint.
Drawpunkt may notify the affected user and may accept a counter-notice where permitted by applicable law.
Repeated infringement may result in account restriction or permanent termination.
False, misleading or abusive copyright complaints may have legal consequences.
20. REPORTING CONTENT
Users may report artwork, comments, replies, profiles, channels or chat messages using available reporting tools or the Contact page.
Reports should be made honestly and should include enough information for review.
You must not use reporting tools to harass users, suppress lawful criticism, manipulate competition or submit knowingly false claims.
Submitting a report does not guarantee removal. Drawpunkt may consider context, evidence, applicable law and these Terms.
21. MODERATION AND ENFORCEMENT
Drawpunkt may use automated systems, manual review or both to detect and address violations.
Depending on the nature, severity, frequency and context of a violation, Drawpunkt may:
• Issue a warning;
• Reject or remove content;
• Disable comments or chat access;
• Hide or archive artwork;
• Restrict publication;
• Pause or close an artist channel;
• Remove fraudulent engagement;
• Require account verification;
• Temporarily suspend an account;
• Apply a 15-day suspension;
• Apply a 30-day suspension;
• Permanently ban an account;
• Preserve relevant records;
• Report activity to competent authorities when required.
The progressive 15-day, 30-day and permanent-ban structure may generally be used for repeated violations. Drawpunkt may skip intermediate stages when conduct is severe, unlawful, dangerous, fraudulent or presents an immediate risk.
Attempts to evade enforcement through another account may result in restriction of all related accounts.
22. MODERATION DECISIONS AND APPEALS
Where an appeal or contact mechanism is available, a user may request review of a moderation decision.
An appeal should identify:
• The affected account or content;
• The decision being challenged;
• Why the user believes the decision was incorrect;
• Any relevant evidence or context.
Submitting an appeal does not automatically restore content or account access.
Drawpunkt may maintain a restriction while an appeal is reviewed where necessary for safety, security or legal compliance.
Repeated, abusive or fraudulent appeals may be rejected.
23. PLATFORM SECURITY
You must not:
• Probe or scan the Service for vulnerabilities without written authorization;
• Bypass authentication, authorization or rate limits;
• Access another user’s account or private data;
• Inject scripts, SQL, commands or malicious code;
• Interfere with servers, databases or network resources;
• Scrape the Service in a manner that creates excessive load;
• Reverse engineer security mechanisms;
• Use bots to create accounts, messages or engagement;
• Upload files designed to disguise executable content;
• Exploit a vulnerability instead of responsibly reporting it.
Security problems should be reported privately using the Contact page or support email.
Publicly disclosing an uncorrected vulnerability in a manner that creates a material risk may violate these Terms.
24. ACCOUNT SUSPENSION AND TERMINATION
You may stop using Drawpunkt at any time.
Where account cancellation is available, cancellation may permanently disable your account and remove or anonymize associated profile information.
Some information may remain where reasonably required for:
• Legal obligations;
• Fraud and abuse prevention;
• Security investigations;
• Dispute resolution;
• Enforcement records;
• Backup integrity;
• Copyright or other legal claims.
Drawpunkt may suspend or terminate an account that violates these Terms, creates risk, remains involved in fraudulent activity or must be restricted by law.
Permanent termination may prevent the user from registering another account.
25. CONTENT REMOVAL AFTER ACCOUNT CLOSURE
Closing an account does not guarantee immediate removal of every copy of content from backups, caches, search engine indexes or third-party pages.
Public content may remain temporarily accessible through technical caches after removal from active Drawpunkt pages.
Comments or replies may be removed, anonymized or retained where necessary to preserve conversation integrity, enforcement evidence or legal records.
Drawpunkt will process deletion requests in accordance with applicable law and its Privacy Policy.
26. THIRD-PARTY SERVICES AND LINKS
Drawpunkt may contain links to third-party websites, advertising services, hosting providers, analytics tools or embedded services.
Drawpunkt does not control every third-party service and is not responsible for third-party availability, security, terms, content or privacy practices.
Your use of third-party services may be governed by separate terms.
27. SERVICE AVAILABILITY
Drawpunkt aims to provide a reliable Service but does not guarantee uninterrupted or error-free availability.
The Service may be unavailable because of:
• Maintenance;
• Software updates;
• Hosting failures;
• Network interruptions;
• Security incidents;
• Database problems;
• Force majeure events;
• Legal or regulatory requirements;
• Circumstances outside reasonable control.
Features and stored content may occasionally be delayed, damaged or lost. You should maintain independent copies of important artwork.
28. BETA AND EXPERIMENTAL FEATURES
Some features may be identified as beta, preview, test or experimental.
Experimental features may be incomplete, changed frequently or removed without notice.
You use experimental features at your own risk and should not rely on them as the only storage location for important content.
29. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, Drawpunkt is provided on an “as is” and “as available” basis.
Drawpunkt does not guarantee that:
• The Service will always be available;
• Every feature will operate without error;
• Content will never be lost;
• Replay data will reproduce identically on every device;
• User-generated content will be accurate or lawful;
• Every harmful message will be detected immediately;
• Every notification will be delivered;
• Artist ratings will reflect professional quality;
• The Service will meet every user’s individual requirements.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
30. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Drawpunkt and its operators, administrators, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from use of the Service.
This may include loss of data, artwork, reputation, opportunity, income, audience, subscriptions or expected benefits.
Nothing in these Terms limits liability where limitation is prohibited by law, including liability that cannot legally be excluded for fraud, intentional misconduct, death or personal injury.
31. USER RESPONSIBILITY AND INDEMNITY
You are responsible for your content, account activity and use of the Service.
To the extent permitted by applicable law, you agree to defend and indemnify Drawpunkt and its operators against third-party claims arising from:
• Content you upload or publish;
• Your infringement of another person’s rights;
• Your unlawful use of the Service;
• Your material violation of these Terms;
• Fraudulent or malicious activity conducted through your account.
This obligation does not apply where a claim results solely from Drawpunkt’s own unlawful conduct.
32. PRIVACY AND COOKIES
Drawpunkt’s collection and use of personal information are described in the Privacy Policy.
The use of cookies and similar technologies is described in the Cookie Policy.
These Terms, the Privacy Policy and the Cookie Policy should be read together.
If consent is legally required for non-essential cookies or personalized advertising, Drawpunkt will seek consent through available consent controls.
33. CHANGES TO THE SERVICE
Drawpunkt may change the Service to improve performance, introduce features, respond to security concerns, comply with law or discontinue features that are no longer practical.
Where reasonably possible, Drawpunkt may provide notice of material changes that significantly affect registered users.
Drawpunkt is not required to preserve a particular design, feature, eligibility rule, ranking method or storage format permanently.
34. CHANGES TO THESE TERMS
Drawpunkt may update these Terms when the Service, law, safety requirements or business practices change.
The updated version will display a revised “Last Updated” date.
Where required by law or where changes materially affect user rights, Drawpunkt may provide additional notice.
Continued use after updated Terms take effect constitutes acceptance where permitted by law.
If you do not agree to an updated version, you must stop using the Service and may use available account cancellation controls.
35. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws that apply to the Drawpunkt operator, subject to mandatory consumer protections and other rights that apply in the user’s country of residence.
Before starting formal proceedings, users are encouraged to contact Drawpunkt and attempt to resolve the issue informally.
Nothing in these Terms removes a user’s right to contact a competent court, consumer authority, data protection authority or other regulator where that right is provided by law.
The Drawpunkt operator’s legal identity, business address and applicable jurisdiction should be published on the Contact page before commercial launch.
36. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
The invalid provision will be interpreted or limited only to the minimum extent necessary to make it lawful and enforceable where permitted.
37. NO WAIVER
If Drawpunkt does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.
38. TRANSFER
You may not transfer your rights or obligations under these Terms without prior written permission.
Drawpunkt may transfer its rights and obligations as part of a merger, acquisition, restructuring, asset transfer or change of operator, subject to applicable law.
39. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Cookie Policy, applicable competition rules and any clearly identified additional terms, form the agreement governing your use of Drawpunkt.
